Somewhere in your company right now, someone is pasting confidential customer data into ChatGPT. Someone else is using an AI tool to screen resumes. A third person is generating marketing copy with Gemini without telling anyone. This isn't hypothetical. Research from Microsoft and LinkedIn shows that 78% of knowledge workers use AI at work, and more than half of them haven't told their managers.
This is the reality that makes an AI policy not just a compliance checkbox, but an operational necessity. Without clear guidelines, you're not just risking regulatory trouble under the EU AI Act. You're risking data leaks, biased decisions, reputational damage, and a workforce that's making it up as they go.
The good news: writing an effective AI policy doesn't require a team of lawyers and six months of committee meetings. It requires clarity about what you want, what you're willing to accept, and what your people need to know.
Before writing a single rule, you need to know what AI is actually being used in your organization. Not what you think is being used. What is actually being used.
This means conducting an AI inventory. Send a survey. Talk to department heads. Check procurement records. Look at browser extensions, SaaS subscriptions, and software integrations. You'll almost certainly find AI tools you didn't know about. Shadow AI, the organizational equivalent of shadow IT, is the norm in 2026, not the exception.
Your inventory should capture four things for each AI tool: what it does, who uses it, what data it processes, and whether it makes or supports decisions that affect people. That last point matters enormously under the EU AI Act, because AI systems that affect employment, creditworthiness, education access, or public services are classified as high-risk under Article 6 and Annex III.
Don't aim for perfection in this step. Aim for visibility. You can't govern what you can't see.
Not all AI use carries the same risk. A team using ChatGPT to brainstorm marketing slogans is fundamentally different from a team using an AI model to score credit applications. Your policy needs to reflect this difference.
The EU AI Act provides a useful starting framework with its four-tier risk classification: unacceptable risk (banned), high risk (heavily regulated), limited risk (transparency obligations), and minimal risk (essentially unregulated). But your internal policy should go further.

Create a simple decision matrix that maps AI use cases to risk levels based on three factors: the sensitivity of data involved, the impact of AI-generated decisions on people, and the degree of human oversight in the process. A practical approach is a traffic light system. Green: use freely with basic guidelines. Yellow: use with approval and additional safeguards. Red: prohibited without formal assessment and executive sign-off.
For example, using AI to summarize meeting notes might be green. Using AI to draft client communications might be yellow, because it involves your brand voice and potentially confidential information. Using AI to evaluate employee performance is red, because it directly affects people's careers and falls under high-risk AI regulation.
Document these categories clearly. Ambiguity is the enemy of compliance.
The single most important section of any AI policy is the one about data. This is where organizations get burned, and it's where the EU AI Act, GDPR, and basic business sense all converge.
Your policy should explicitly state what data can and cannot be entered into AI systems. At minimum, establish these categories:
This sounds obvious, but most organizations discover that their employees have been routinely violating these boundaries. Not maliciously. They simply didn't know the rules because there were no rules.
Also address data retention. When an employee uses ChatGPT, does OpenAI store that conversation? For how long? Can it be used to train future models? These questions matter under GDPR Article 5 (storage limitation) and they matter practically. Some AI providers, particularly enterprise versions, offer zero-data-retention agreements. Your policy should specify which versions of AI tools are approved for use.
A policy without accountability is a suggestion. Every AI policy needs clear ownership and escalation paths.
Assign an AI governance lead, or at minimum, designate someone within your existing compliance or risk team who owns AI governance. For organizations with more than 50 employees, Article 4 of the EU AI Act requires that staff involved in the operation and use of AI systems have sufficient AI literacy. Someone needs to be responsible for making that happen.
Your governance structure should define:
Who approves new AI tools. Don't create bureaucratic bottlenecks, but don't let every team independently adopt whatever AI tool they discover on Product Hunt either. A lightweight approval process, perhaps a simple form reviewed by IT and compliance within five business days, prevents shadow AI from growing while keeping innovation speed acceptable.
Who monitors ongoing use. AI tools change. Providers update their models, their terms of service, and their data handling practices. Someone needs to track these changes and assess whether they affect your risk posture. Set a quarterly review cadence at minimum.
Who handles incidents. When, not if, something goes wrong, who do employees report to? If an AI tool generates biased output, if confidential data is accidentally shared, if a customer complains about an AI-generated communication. Define the escalation path before you need it.
Who documents compliance. Under the EU AI Act, deployers of high-risk AI systems must maintain logs and documentation. Even for lower-risk AI use, maintaining records of what tools you use, how you assessed their risk, and what controls you've implemented is the foundation of audit readiness.
The best AI policy in the world is useless if it lives in a SharePoint folder nobody opens. Communication is not optional. It's the step that determines whether your policy actually changes behavior.
Start with a company-wide announcement. Explain not just the rules, but the reasoning. People follow rules they understand. "Don't put customer data into ChatGPT" is a rule. "ChatGPT sends your input to OpenAI servers in the US, where it may be reviewed by their staff and potentially used for model training, which means pasting customer data creates a GDPR violation and a data breach" is a reason. The reason sticks.
Then invest in training. Not a single webinar that everyone forgets. Structured, role-specific AI literacy training that covers what AI can and cannot do, how to evaluate AI output critically, what the EU AI Act requires, and what your specific organizational policy says. Article 4 of the EU AI Act makes this a legal obligation, not a nice-to-have.
Finally, commit to iteration. Your AI policy is a living document. The technology changes quarterly. New AI tools emerge. Regulatory guidance evolves. The EU AI Office issues new technical standards. Set a review schedule, at minimum every six months, and actually follow it.
The organizations that get AI governance right aren't the ones with the thickest policy documents. They're the ones that treat their AI policy as a practical tool that evolves with the technology and the regulations. Start with these five steps, keep it clear, keep it human, and keep it current. Your team will thank you, and your compliance posture will be ready for whatever the EU AI Act enforcement brings next.
