The EU AI Act has been the talk of boardrooms across Europe since its entry into force in August 2024. Compliance teams are scrambling to classify their AI systems, legal departments are dissecting the regulation's 180+ pages, and consultants are having their best year since GDPR. But in all this noise, one critical topic gets surprisingly little attention: what actually happens when you violate the rules?
The answer is not abstract. The EU AI Act establishes one of the most detailed penalty frameworks in European regulatory history. Three tiers of fines, each linked to specific categories of violations, with amounts that make GDPR penalties look modest. Understanding this framework isn't about fear. It's about knowing exactly where the highest risks lie so you can allocate your compliance resources where they matter most.
The EU AI Act organizes its fines into three distinct tiers, each tied to the severity of the violation. This isn't arbitrary. The structure mirrors the regulation's risk-based approach, where higher-risk violations attract proportionally larger penalties.
Tier 1: €35 million or 7% of global annual turnover applies to violations of the prohibited AI practices listed in Article 5. These are the absolute red lines: AI systems that use subliminal techniques to manipulate behavior, exploit vulnerabilities of specific groups, deploy social scoring by public authorities, or use real-time remote biometric identification in public spaces (with narrow exceptions for law enforcement). If your organization deploys any of these, you're looking at the maximum penalty category.
For context, 7% of global turnover for a company like Siemens would exceed €4.7 billion. For a mid-sized firm with €100 million in revenue, it's €7 million. These aren't theoretical numbers. The regulation explicitly states that the higher of the two amounts applies.
Tier 2: €15 million or 3% of global annual turnover covers most other violations of the regulation. This includes failing to meet the requirements for high-risk AI systems under Articles 8 through 15, not conducting required conformity assessments, failing to register high-risk systems in the EU database, or not meeting transparency obligations. If you deploy a high-risk AI system in recruitment, credit scoring, or healthcare without proper documentation, risk management, and human oversight, this is your penalty bracket.

Tier 3: €7.5 million or 1% of global annual turnover targets a specific but important violation: providing incorrect, incomplete, or misleading information to notified bodies or national authorities. This might sound minor, but it's designed to prevent companies from gaming the compliance process. If you understate your AI system's capabilities during a conformity assessment or provide incomplete technical documentation to regulators, this penalty applies.
One of the most important distinctions in the EU AI Act's penalty framework is who bears responsibility. The regulation distinguishes between providers (those who develop or place AI systems on the market) and deployers (those who use AI systems in their operations).
Providers face the full weight of the penalty framework. If you build an AI system that's classified as high-risk, you're responsible for ensuring it meets all the technical requirements: accuracy, robustness, cybersecurity, data governance, transparency, and human oversight. Failure on any of these fronts exposes you to Tier 2 penalties.
Deployers, which is what most organizations are, face a somewhat different set of obligations. Under Articles 26 and 27, deployers must use high-risk AI systems in accordance with the provider's instructions, ensure human oversight, monitor the system's operation, and conduct a fundamental rights impact assessment (FRIA) before deploying high-risk systems in certain contexts.
Here's where it gets practical. If you're an HR department using an AI recruitment tool, you're a deployer. If that tool is classified as high-risk (which recruitment AI is, under Annex III), you need to ensure you're using it correctly, monitoring its outputs, maintaining human oversight over hiring decisions, and documenting everything. The provider built the system. You're responsible for how you use it.
What many compliance teams overlook is that EU AI Act violations rarely occur in isolation. An AI system that violates the EU AI Act is very likely to simultaneously violate GDPR. Consider an AI credit scoring system that lacks adequate transparency. Under the EU AI Act, that's a Tier 2 violation (up to €15 million or 3% of turnover). Under GDPR Article 22, automated decision-making that significantly affects individuals requires meaningful information about the logic involved. That's a separate violation with its own penalty framework (up to €20 million or 4% of turnover under GDPR).
The regulators are aware of this overlap. The EU AI Act explicitly states in Article 99(5) that when determining fines, authorities should take into account penalties already imposed under other EU or national legislation for the same infringement. But "take into account" doesn't mean "subtract." Organizations could face cumulative penalties from multiple regulatory frameworks for a single AI system that falls short.
The EU AI Act establishes the framework, but enforcement happens at the national level. Each EU member state must designate a national supervisory authority responsible for AI Act enforcement, similar to how data protection authorities enforce GDPR.
This creates a familiar pattern of enforcement variability. Some national authorities will be aggressive and well-resourced. Others will be cautious and understaffed. The Netherlands, with its existing Algorithm Supervisory Authority (part of the Autoriteit Persoonsgegevens), is likely to be among the more active enforcers. Ireland, which handles Big Tech enforcement under GDPR, will face similar pressure regarding AI.
For organizations operating across multiple EU member states, this means your effective enforcement risk depends partly on where you operate and which authority takes the lead. But unlike early GDPR enforcement, the EU AI Office, established under Article 64, provides a central coordination mechanism that should reduce the inconsistencies we saw in GDPR's first years.
Not all provisions of the EU AI Act carry enforcement risk at the same time. The regulation follows a phased implementation:
Already in force (since February 2025): prohibitions on unacceptable-risk AI practices (Article 5). This means Tier 1 penalties, the €35 million category, are already enforceable. If your organization uses social scoring, manipulative AI, or unauthorized biometric identification, you're already exposed.
August 2025: obligations for general-purpose AI models (Chapter V) and the governance framework (Chapter VII) become enforceable.
August 2026: the full set of requirements for high-risk AI systems takes effect. This is when Tier 2 penalties for non-compliant high-risk systems become live.
This timeline means organizations have a narrowing window to get their house in order. The prohibited practices are already enforceable. High-risk system requirements are less than 18 months away. Waiting is not a strategy.
The organizations that will navigate this penalty framework successfully aren't the ones with the thickest compliance manuals. They're the ones taking four practical steps.
First, they're conducting an AI inventory to know exactly which AI systems they use, whether as providers or deployers, and how each system maps to the risk classification framework.
Second, they're prioritizing the highest-penalty-risk areas first. Prohibited practices (Tier 1) deserve immediate attention. High-risk systems in HR, finance, healthcare, and government (Tier 2) come next.
Third, they're investing in AI literacy across their organization. Article 4 requires that all staff involved in the operation and use of AI systems have sufficient understanding of these systems. This isn't a nice-to-have. It's a legally mandated competence that, if missing, could contribute to violations that trigger penalties.
Fourth, they're building documentation and audit trails now, before enforcement begins. The organizations that can demonstrate good-faith compliance efforts, even if imperfect, will fare better than those that haven't started. Regulatory authorities across the EU have consistently shown more leniency toward organizations that demonstrate proactive compliance efforts.
The EU AI Act's penalty framework is designed to be taken seriously. With maximum fines exceeding those under GDPR, the regulation sends a clear message: responsible AI isn't optional, and the cost of getting it wrong goes far beyond reputation.
