Of all the provisions in the EU AI Act, Article 4 may be the most broadly applicable and the most underestimated. While much attention has focused on high-risk AI requirements and prohibited practices, Article 4 applies to virtually every organization that uses AI in any capacity.
The requirement is deceptively simple: ensure that your people have sufficient AI literacy. The implications are significant.
Article 4 states that providers and deployers of AI systems shall take measures to ensure, to their best extent, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf.
Several elements of this text deserve careful attention.
"Providers and deployers" means this applies whether you build AI systems or simply use them. If your organization uses ChatGPT, AI-powered analytics tools, AI recruitment software, or any other AI system, you are a deployer. Article 4 applies to you.
"To their best extent" provides some proportionality. A 10-person startup is not expected to implement the same AI literacy program as a multinational bank. But "to their best extent" is not an escape clause. Regulators will expect genuine, documented effort proportional to your organization's size and AI usage.
"Sufficient level of AI literacy" is intentionally flexible. What counts as sufficient depends on context: the types of AI systems used, the decisions they inform, the people affected by those decisions, and the risks involved.
"Staff and other persons dealing with the operation and use" extends beyond employees. It includes contractors, consultants, and anyone else who interacts with AI systems on your organization's behalf.
Article 4 entered into force on February 2, 2025. This is not a future requirement. It is active now.
Unlike the high-risk AI provisions that have staggered deadlines into 2026 and 2027, the AI literacy requirement is already enforceable. Organizations that have not yet addressed it are already potentially non-compliant.

The short answer: anyone in your organization who interacts with AI systems. In practice, this typically includes several categories of staff.
Direct AI users. People who operate AI tools as part of their daily work. This includes marketing teams using AI content tools, HR teams using AI recruitment platforms, customer service agents working with AI chatbots, analysts using AI-powered data tools, and developers working with AI coding assistants.
Decision makers who use AI outputs. Managers and leaders who receive AI-generated reports, recommendations, or analyses and use them to make business decisions. They need enough literacy to evaluate AI outputs critically and understand their limitations.
AI oversight personnel. Anyone responsible for monitoring, auditing, or governing AI systems. This group needs deeper AI literacy that covers technical functioning, risk assessment, and regulatory requirements.
Procurement and vendor management. People who select and contract AI tools and services need sufficient literacy to evaluate AI products, assess vendor compliance claims, and negotiate appropriate contractual protections.
The AI Act does not prescribe a specific curriculum or certification. Instead, it takes a principles-based approach. Sufficient AI literacy should enable people to:
Understand what AI is and how it works at a level appropriate to their role. A developer needs deeper technical understanding than a marketing manager, but both need foundational knowledge.
Recognize the capabilities and limitations of the AI systems they work with. This means understanding what the AI can reliably do, where it is likely to fail, and what the consequences of failure might be.
Use AI systems effectively and responsibly. This includes practical skills like prompt engineering as well as judgment skills like knowing when to trust AI output and when to verify it independently.
Understand the ethical and legal context. Everyone working with AI should understand basic concepts of fairness, transparency, privacy, and the regulatory framework that applies to their organization.
Identify and report problems. Staff should know how to recognize when an AI system is behaving unexpectedly and have clear channels for reporting concerns.
Step 1: Assess your current state. Map which AI systems your organization uses and who interacts with them. Identify gaps between current knowledge levels and what Article 4 requires.
Step 2: Define role-appropriate literacy levels. Not everyone needs the same depth of knowledge. Create tiered learning paths that match the AI literacy requirements to each role's interaction with AI systems.
Step 3: Implement training. Provide structured AI literacy education. This should go beyond a single awareness session. Effective AI literacy building is ongoing and includes practical, hands-on elements specific to the AI tools people actually use.
Step 4: Document your efforts. Maintain records of what training was provided, to whom, and when. Document your AI literacy framework, the rationale behind your approach, and how you assess literacy levels. This documentation is your evidence of "best extent" compliance.
Step 5: Review and update regularly. AI technology and regulation both evolve. Your AI literacy program should be reviewed at least annually to ensure it remains current and sufficient.
Article 4 violations can result in fines up to 15 million euros or 3% of total worldwide annual turnover, whichever is higher. While enforcement is still in early stages, regulators have signaled that AI literacy will be a focus area. Organizations that cannot demonstrate Article 4 compliance may also face increased scrutiny of their other AI Act obligations.
Compliance aside, AI-literate teams simply perform better with AI tools. They make fewer errors, identify more opportunities, manage risks more effectively, and adopt new AI tools faster. The investment in AI literacy pays for itself in productivity and risk reduction.
